Inheritance transfers not only assets but also the deceased's debts to the heirs. For this reason, the Turkish Civil Code grants heirs the right to renounce an inheritance.
Renunciation must be declared, either in writing or verbally, to the civil court of peace in the deceased's place of residence within three months of the heir becoming aware of their status as heir. This period is a strict statutory deadline.
If the deceased was over-indebted at the time of death, renunciation may be presumed; however, this must be established by a court decision.
Once renunciation is completed, the heir loses their status as heir and cannot be held liable for the deceased's debts. The renouncing heir's share then passes to the other heirs according to the order set out in the law.
